Legal and Regulatory | Product Use and Regulatory Notice

Last updated: October 16, 2026

This notice applies to every product supplied by Kleos Health Inc. (“Kleos”) and to all information Kleos provides about its products. It forms part of the Kleos Terms and Conditions of Sale.

1. Professional use only

Kleos supplies its products exclusively to licensed healthcare and aesthetic professionals, clinics and businesses for use in their practice. Products are not sold to consumers. Purchasers are responsible for holding every licence, registration and permit that applies to them and to the products they buy.

2. Cosmetic products are cosmetics

Products that Kleos identifies as cosmetics on their labelling are manufactured, imported, marketed and sold solely as cosmetics as defined in the Food and Drugs Act (Canada) and the United States Federal Food, Drug, and Cosmetic Act. They are preparations intended to be applied topically to the skin, hair or scalp, as directed in their labelling, to cleanse, beautify, promote attractiveness, or improve or alter the appearance of the skin or hair.

Kleos cosmetic products:

  • are intended for topical application to the skin, hair or scalp only, as directed in their labelling;

  • are not drugs, biologics, natural health products or medical devices, and are not sterile unless their labelling states so;

  • are not intended, represented or sold for injection, infusion, implantation, inhalation, ingestion, or any route of administration other than the topical application described in their labelling;

  • are not intended to diagnose, treat, cure, mitigate or prevent any disease or medical condition, or to affect the structure or any function of the body; and

  • make no therapeutic or medical claim. Any description of a product on our website, in our materials or by our representatives refers to cosmetic effects on the appearance of the skin or hair.

3. Medical devices and other regulated products

Medical devices supplied by Kleos are sold for the intended use, indications and user population stated in their applicable Health Canada medical device licence (or, for Class I devices, their labelling) or their US FDA marketing authorization, and in their labelling. Kleos Health Inc. holds a Medical Device Establishment Licence issued by Health Canada; it is a Canadian establishment licence and does not authorize distribution or use in any other country. Natural health products and other regulated products are sold for the use stated in their licence and labelling. Regulatory status differs between Canada and the United States; purchasers are responsible for confirming that a product may lawfully be received and used at their location.

4. Use outside the labelling is the practitioner's decision alone

Kleos does not recommend, endorse, instruct, train, promote or authorize the use of any product in any way other than as described in sections 2 and 3 and in the product labelling. Any decision by a professional to use a product in any other way, including any so-called off-label, unapproved, combined, modified, reconstituted or non-topical use, is that professional’s own independent clinical and professional decision, made in the exercise of his or her own judgment and under his or her own licence, without any involvement by Kleos, and contrary to Kleos’s terms of sale. Kleos accepts no responsibility or liability for any such use or its consequences, and the purchaser indemnifies Kleos for it.

5. Information, training and protocols

Information that Kleos provides, including training, protocols, brochures, website content, social media and discussions with Kleos’s team or representatives, is general product information for licensed professionals. It is not medical advice and does not replace the professional’s own judgment, the product labelling, or the laws and professional standards that apply to the professional. Unless a product’s labelling expressly states otherwise, every Kleos protocol and training describes topical cosmetic use.

6. Results

Results vary from person to person. Kleos does not guarantee any particular cosmetic, aesthetic, clinical or commercial result from any product.

7. Reporting

Please report any product complaint, quality concern or adverse event involving a Kleos product to support@kleoshealthcare.com or +1 (604) 353-5582. Keep the product, its packaging and its lot number for investigation.
